Definitions of terms
Southdown Aquatics’ refers to the company trading as ‘Southdown Aquatics’ and to the website of the said company.
‘We’, ‘Ourselves’, ‘Our’, and ‘Us’ refers to ‘Southdown Aquatics’ as detailed above.
‘You’, ‘Your’, ‘Youselves’, and ‘The Customer’, refers to you, the user of this site, and anyone who purchases or has purchased goods or services from Southdown Aquatics.

Please read these terms and conditions carefully before ordering any products or services from our website. You should understand that by ordering from our site, over the phone or through our company in any way, or by using our site, you agree to be bound by these terms and conditions. If you do not agree with any part of these terms and conditions you should not use our website or order through us. Please read through these terms and conditions carefully and print a copy for future reference.
The Website and its content may not be copied, imitated, reproduced, republished, uploaded, posted, transmitted, modified, indexed, catalogued, mirrored or distributed in any way, in whole or in part, without the express prior written consent of Southdown Aquatics. You may not sell or resell any part of the Website or access to the Website. You may not use any of the software that is used in the operation or provision of the Website except while you are using the Website in accordance with this agreement.

ALL OUR VIVARIUMS, STANDS AND AQUARIUM HOODS WILL ONLY BE DELIVERED BY US WITHIN OUR DELIVERY RANGE.
ALL OUR ITEMS ARE MADE TO ORDER SO WE RUN TO A GENERAL SIX WEEK TURNAROUND TIME.
Please see image for approx delivery range all within the black zone (excluding red zone in London). Please contact us if you are unsure or are on the edge of our zone. We hand deliver all our Vivariums, stands and Hoods. Due to the difficult delivery restrictions and ULEZ zones within central London anything within the red zone on the image we will not be able to deliver.
WE WILL ONLY BE DELIVERING ALL SIZES WITHIN AN APPROXIMATE TWO HOUR DISTANCE FROM STEYNING, WEST SUSSEX.
PLEASE BE AWARE IF YOU ORDER WHEN YOU ARE OUTSIDE OF OUR DELIVERY ZONE WE WILL NOT BE ABLE TO REFUND PAYPAL FEES.

Covid19: All deliveries are carried out from a safe distance and is to your ground floor outside door only. Being a small family run business (and having high school age children in our family) there may be delays on deliveries (or we may have to rearrange booked deliveries) if we have to self isolate. Unfortunately this is out of our hands if we have to cancel any booked deliveries due to either a close contact isolation or a positive COVID test.
All deliveries are to ground floor only. We won’t be able to carry to flats or first floor etc.
LONDON AREAS – Due to traffic, unloading restrictions, parking, cycle only roads and the general time it takes us to deliver within some areas of London please contact us before ordering (we will not deliver within ULEZ or within the red zone on our delivery zone image). Also some areas are now restricted with no driving on the roads in London with school/cycle/walk/street closed only roads. If we are going to struggle to get to you or cannot access your road we reserve the right to cancel your order at any time.
We do have a contact for an outside furniture courier. They are a bespoke courier who deliver nationwide. Due to the costs involved and and prices are based on individual sizes and delivery area customers will have to contact them directly. The company is called Proovia.
Accessories and Frozen foods are dispatched within 48 hours or up to Ten days depending on stock availability. We do not hold all accessories in stock.
All our Reptile Vivariums, Stands and Aquatic Aquarium Hoods are all made to order so therefore can take up to Six weeks depending on how busy we are. We realise this is a long dispatch time but we manufacture everything to order and offer ten different colours on each size. We also have to take into consideration build time, ordering materials that are out of stock (boards, glass etc.) staff illnesses, weather restrictions, suppliers delaying materials etc. We will always, where we can, inform you of any delays but please do not hesitate to ask on the progress of your order.
Please be aware any products hand delivered by us do not come with any packaging.
COLLECTION If a customer collects their product Southdown Aquatics is not responsible for any damages in transit, once it leaves our workshop/yard it becomes the responsibility of the person collecting/transporting.
We offer a bespoke service so please contact us for quote if you require a different size.
We hand deliver all our Vivariums, Stands and Aquarium Hoods so aLl sizes can only be delivered will be within our TWO HOUR delivery zone from Steyning, West Sussex. Please see image for delivery zones. We cannot deliver within the London red zone. We also refuse the right to deliver if your road has restricted access e.g cycle only.
Deliveries are to ground floor only unless agreed by us in writing in advance.
We welcome collections and we have courier contact information for customers outside our delivery range if you wanted to organise a delivery to your area. Anything organised by an outside courier becomes the responsibility of the person/courier transporting.
Please see refunds/cancellations for refund information but due to PayPal charging fees on refunds if a customer orders a vivarium that is outside of our delivery area, we can no longer refund the full amount so the fees will have to be charged. Unfortunately this is out of our control. It is important to read our delivery information before ordering.
All our products are extremely easy to assemble, please ask if you require any help with assembly or an instruction page (we can email these to you). Anything that is sent via a courier company will be sent flat packed. Most sizes and stands that we deliver will be flat packed. Sometimes depending on the space we have on our deliveries we will deliver some smaller items assembled but we can’t guarantee it.
Southdown Aquatics will at all times give our best endeavour to ensure a comprehensive delivery service but cannot be held responsible for any delays that are outside of our control e.g. weather restrictions.
Items that we hand deliver or are sent by courier are our responsibility until a customer takes delivery (Excludes collected items by the customer or an outside courier that the customer themselves has organised/booked). You must note when signing for the delivery any packaging damage, and if possible do not sign for deliveries as unchecked. Any instructions given for an unsigned delivery i.e. Please leave in garden shed are at the customers discretion, the customer shall be responsible for any packages which may go missing under these circumstances.
Any shortages must be reported to us by phone or email within a reasonable time. In normal circumstances we would request that you report these within 48 hours of delivery to enable us to rectify the problem as soon as possible. Any items lost by a courier that the customer themselves have booked are not the responsibility of Southdown Aquatics, we will of course help in any way we can. We have an extensive check list for items collected by a courier.
Delivery guaranteed subject force major and customer being available to accept delivery on first attempt (or giving special instructions for parcel(s) to be left in a safe place). Any parcels delivered via the courier * will be attempted next working day from dispatch, if no one is home they will attempt to make the delivery one more time the following working day. After this your parcel will go to the local depot for collection, if you require to have the parcel redelivered after the two attempts this may incur a delivery charge. This does not include any items that a customer has organised through a courier themselves or collected.
Southdown Aquatics reserve the right to cancel an order at any time for any reasons beyond our control.
All our products are made to order and therefore non refundable (please see your rights under faulty goods).
We at Southdown Aquatics manufacture all our products to the customers specification e.g. size and colour. We do not keep anything in stock so we order materials, glass etc once the customer has selected the size and colour they require.
If you change your mind once you have ordered your vivarium we will take reasonable steps to see if we can offer you a refund, this is dependant on the size of your vivarium and whether we have started to manufacture your order or if it is out for delivery (fees will not be refunded).
Once you have taken delivery of the products to your home there will be no option for a refund (please see faulty goods for consumer rights).
We reserve the right to cancel any orders that may not be able to be fulfilled due to illness within the business and our staff.
Due to PayPal now charging fees on refunds we no longer be able to refund fees on cancelled items (Unless the item is out of stock and we can no longer provide the product).
This includes orders that are outside of our delivery zones.
Please see full shipping restrictions before ordering as we cannot refund fees if shipping conditions/delivery areas/handling and build time are not checked before ordering.
We work in line with Consumer rights act which states that any goods purchased should be as described, of satisfactory quality and fit for the purpose for which they were intended. Your rights vary depending on the nature of the fault and the length of time you have had the goods.
If your products has arrived damaged then please inform us straight away (this excludes items that a customer has booked with a courier or transported themselves) we may ask for proof of damage e.g. photos, so we can ascertain what repairs need to be done. With any faulty product we will either repair or replace as soon as possible, you legally have 30days to tell us of any damaged caused by delivery or a faulty product but please do tell us as soon as you can as we will endeavour to repair or replace asap.
We will not refund, repair or replace any product that has been damaged by the customer. Please see General Terms and conditions below.
GENERAL TERMS AND CONDITIONS
We will not replace or repair a product that has been damaged by water, damaged caused in assembling it incorrectly or general wear and tear.
We will not take responsibility in a product being damaged by items or other furniture or heavy items being placed in or on top as this could affect the structure of the product, unless requested in advance and we have agreed to this in writing (e.g we have agreed to make it structurally suitable and have agreed make alterations to the Vivarium).
All Vivariums must be used within it’s capabilities e.g over heating a Vivarium may affect its long term use as it could burn the Vivarium or make the wood expand. We take no responsibility for any animal or reptile being injured in a Vivarium as how a customer chooses to use their Vivarium is completely out of our hands and we trust that a customer will know how their reptile is meant to be kept.
We recommend that any new vivarium be fully assembled and glass checked before dismantling any other enclosures your reptile is in.
We want to continue to offer as many colours as possible. Due to the nature of the boards and some colours, e.g. white, will show blemishes. We pride ourselves on high quality sturdy vivariums but some blemishes in manufacture is unavoidable due to the nature of the wood (chipboard core).
We as Southdown Aquatics take no responsibility in maintaining a vivarium correctly. All vivariums MUST be sealed with Aquatic grade silicone, we take no responsibility in sealing any of the vivariums delivered and do not offer this. It is the customer’s responsibility to seal their vivarium correctly and maintain the seal, if this is not done properly it could affect the vivarium i.e., swelling of the joints as this is a wood based product.
You must ensure that this is carried out before any reptile, substrate or other materials are placed in the vivarium and the silicone is left to dry for a minimum of 24 hours. Sealing means all corners, joints, ends of track, front and back of track (to prevent damage by water/condensation) We cannot take responsibility for any vivariums that are water damaged, vivariums are humidity resistant but are not water proof.
All vivariums should be sealed regularly. We cannot take responsibility for how long a vivarium will last as it is down to the customers personal usage and maintenance. As stated these are primarily wood products and have limitations to long term usage (and again to how they are maintained). Regular cleaning and maintenance is important, both for the animal and the vivarium.
We recommend that all Aquarium hoods are used with condensation covers on the tank to prevent excess rising moisture. The hoods are humidity/moisture resistant but are not waterproof. We cannot take any responsibility for hoods damaged by water as this is out of our control.
MISPRINTS AND ERRORS, PRODUCT AVAILABILITY AND PRICES
Southdown Aquatics endeavours to provide current and accurate information on the website. However, misprints, errors, inaccuracies and omissions may sometimes occur. Southdown Aquatics reserves the right to:
a) Correct any error, inaccuracy or omission.
b) If an order has already been placed we will advise the customer of the changes. If the customer does not wish to accept the changes we will issue a refund.
LOGIN NAMES AND PASSWORDS
Certain areas and features of the Website are accessible only to users who have been issued a login name and password (collectively “User Details”) by Southdown Aquatics. For the purposes of accessing the Website, the User Details remain the property of Southdown Aquatics and may be cancelled or suspended at any time by Southdown Aquatics in its discretion without any notice or liability to you or any other person. Southdown Aquatics is not under any obligation to verify the actual identity or authority of any person using User Details to access and use the Website. Southdown Aquatics may act upon any communication that is given with the use of User Details. Southdown Aquatics may in its discretion at any time require proof of the identity of any person seeking to access and use the Website, and may deny access to and use of the Website or parts of it or refuse to accept or act upon any communication if Southdown Aquatics is not satisfied with such proof. If you have been issued User Details: (a) you are fully responsible and liable for the security of the User Details and any and all use and misuse of the User Details; (b) you will keep the User Details secure and confidential at all times and not disclose the User Details to any other person or permit any other person to use the User Details; (c) you will ensure that all uses of the User Details comply with this Agreement; (d) once you have logged-on to the Website using the User Details, you will not leave the computer terminal used to access the Website unless and until you have terminated the session and logged-off the Website; and (e) you will immediately notify Southdown Aquatics by telephone or email via the contact page of this Website if you know or suspect that any User Details have been lost or stolen or become known to or used by any other person.
